PetBnC Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") are a legal agreement between you and PetBnC ("PetBnC", "we", "us") governing your use of the PetBnC mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Description of the Service
PetBnC is a marketplace that connects pet owners ("Owners") with hosts and service providers ("Hosts") offering pet boarding, sitting, services, and adoption listings. PetBnC is a venue that facilitates discovery, booking, messaging, and payment between Owners and Hosts. PetBnC is not a party to the arrangement between an Owner and a Host and does not itself provide pet-care services.
3. Eligibility and Accounts
- You must be at least 18 years old to create an account.
- You are responsible for the accuracy of the information in your account and listings, and for keeping your login credentials secure.
- You are responsible for all activity that occurs under your account.
4. Host Responsibilities and Payout Verification
- Hosts must provide accurate listing information, including pricing, availability, and any restrictions (e.g. accepted pet types).
- To receive payouts, Hosts must complete identity verification through Stripe Connect ("Stripe onboarding"). PetBnC will not release a payout, and may block accepting a booking that requires payment, until this verification is complete.
- Hosts are independent third parties, not employees or agents of PetBnC. PetBnC does not guarantee the quality, safety, or legality of any Host's services.
5. Bookings, Payments, and Fees
- Prices are set by Hosts and displayed in the listing. Applicable taxes are calculated automatically based on the booking location and added at checkout.
- Payments are processed securely through Stripe. By booking, you authorize PetBnC to charge your selected payment method for the total price shown, including taxes and any applicable service fee.
- PetBnC may retain a service fee from each transaction; any such fee will be disclosed before you confirm a booking.
6. Cancellations and Refunds
Unless a listing states a different policy, the following cancellation schedule applies to Owner-initiated cancellations, calculated from the booking's start date:
- More than 7 days before the start date: full refund.
- Between 3 and 7 days before the start date: 50% refund.
- Less than 3 days before the start date, or after the booking has started: no refund.
Refunds are issued to the original payment method via Stripe and may take several business days to appear, depending on your bank or card issuer. PetBnC reserves the right to issue exceptions (e.g. full refunds) in cases of Host cancellation, safety concerns, or service failures.
7. Reviews and Conduct
- Reviews must reflect a genuine experience with the booking they relate to. Fraudulent, defamatory, or harassing reviews may be removed.
- You agree to communicate respectfully with other users and not to use the Service to harass, discriminate against, or defraud anyone.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Circumvent PetBnC's payment system to avoid fees (e.g. arranging payment outside the app for a booking made through PetBnC).
- Post false, misleading, or fraudulent listings, reviews, or profile information.
- Upload content that is illegal, abusive, infringing, or that you do not have the right to share.
- Interfere with or attempt to disrupt the Service's normal operation, including by reverse-engineering, scraping, or attacking the app or its backend.
9. Pet Adoption Listings
Adoption listings are provided by Hosts/users and are not verified or guaranteed by PetBnC. PetBnC strongly encourages Owners and adopters to meet animals in person, verify health and vaccination records, and use their own judgment before completing an adoption.
10. Intellectual Property
The PetBnC name, logo, app, and underlying software are owned by PetBnC or its licensors and are protected by intellectual property laws. You retain ownership of content you upload (e.g. listing photos), but grant PetBnC a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content as necessary to operate the Service.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. PETBNC DOES NOT GUARANTEE THE ACCURACY OF LISTINGS, THE CONDUCT OF USERS, OR THE QUALITY OR SAFETY OF ANY HOSTED PET-CARE SERVICE. YOU USE THE SERVICE, AND ENTER INTO ARRANGEMENTS WITH OTHER USERS, AT YOUR OWN RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETBNC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY INTERACTION WITH ANOTHER USER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO PETBNC IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
13. Indemnification
You agree to indemnify and hold PetBnC harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your breach of these Terms, or your interactions with another user.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, engage in fraudulent or harmful conduct, or as required by law.
15. Governing Law and Disputes
These Terms are governed by the laws of Canada and the province in which PetBnC operates, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the courts of that province, unless otherwise required by applicable consumer-protection law.
16. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
